1. Introduction

Welcome to www.starkprocessing.com (the “Site”), operated by From Stark to Finish Inc., doing business as Stark Processing (“Stark Processing,” “we,” “us,” or “our”). We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains what we collect, why we collect it, who we share it with, and the choices you have. It applies to the Site, to our contact and quote forms, to our document upload portals, and to the SMS text messaging program described in Section 5. By accessing or using the Site, you agree to this Privacy Policy.

2. Information We Collect

We collect personal information that you voluntarily provide when you complete a form on the Site, request a quote, upload documents, subscribe to updates, or otherwise contact us. The information we collect depends on how you interact with us and may include:

  • Identity and contact information: name, email address, mobile or landline telephone number, and mailing address.

  • Business and transaction information: company name, job title, loan or property details, purchase price, estimated value, rent, credit range, loan purpose, and any messages or notes you provide.

  • Documents you upload: files you send us for loan processing, which may contain financial and identity information about you or your borrowers.

  • Communications preferences: whether you have consented to receive SMS text messages, and the date, time, and page on which that consent was given.

Note on payments: We do not collect or store payment card numbers or bank account numbers on this Site, and we do not operate a third-party payment processor here.

Information Collected Automatically

When you visit or navigate the Site, we and our analytics and advertising providers automatically collect technical information, including:

  • IP address and approximate country or region derived from it

  • Browser type, device characteristics, and operating system

  • Referring and exit URLs, and pages and features you use

  • Date, time, and duration of your visit

  • Cookie, pixel, and advertising identifiers (see Section 7)

Information About Third Parties You Provide

If you are a mortgage broker, loan officer, or lender submitting information about a borrower, you represent that you have the authority and any required consent to share that information with us, and that you will honor the borrower’s privacy rights.

3. How We Use Your Information

We process personal information to perform a contract with you, in reliance on our legitimate business interests, with your consent, and to comply with our legal obligations. Specifically, we use it:

  • To deliver our services: to perform the loan processing, document review, and consulting services you request.

  • To communicate with you: to respond to inquiries, request feedback, and follow up on files in progress, by email, phone call, or, if you have opted in, SMS text message.

  • To send administrative information: service and feature updates, and changes to our terms, conditions, and policies.

  • To protect our services: fraud monitoring, abuse prevention, security, and troubleshooting.

  • To measure and improve: to understand how the Site is used and to measure the effectiveness of our own marketing.

  • To comply with law: including recordkeeping obligations that apply to mortgage and loan processing activity.

4. How We Share Your Information

We do not sell your personal information, and we do not share it with third parties or affiliates for their own marketing or promotional purposes. We share information only with your consent, to provide the services you requested, to comply with law, to protect our rights, or with the service providers listed below, who are permitted to use it only to perform work on our behalf:

  • Cloud computing and data management: Google (Workspace and Cloud), used to store and process business data securely.

  • Web hosting and infrastructure: Hostinger, Vercel, and our own virtual private server infrastructure. These providers process technical data such as IP addresses to keep the Site secure and performant.

  • Email delivery: Resend, used to send and receive transactional and reply email. If you email us or submit a form, your address and message content are processed through this service.

  • Analytics and advertising measurement: Google Analytics, Google Ads, and Meta (Facebook) Pixel, used to measure Site traffic and the performance of our own advertising. See Section 7.

  • Lending and settlement partners: when you ask us to process or submit a specific loan file, we share the file information with the lender, broker, or settlement service provider you have engaged, so the transaction can proceed.

  • Legal and safety: regulators, law enforcement, auditors, or advisors where required by law or necessary to establish, exercise, or defend legal claims.

  • Business transfers: in connection with a merger, sale, or acquisition, subject to this Policy.

Exclusion: The categories above do not include mobile telephone numbers or SMS opt-in data. See Section 5.

5. Mobile Information and SMS Opt-In Data: No Sharing With Third Parties or Affiliates

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

To state this without ambiguity:

  • We do not sell, rent, lease, trade, or otherwise disclose your mobile telephone number or your SMS opt-in data to any third party, affiliate, marketing partner, lead buyer, lead aggregator, or data broker for that party’s marketing or promotional purposes.

  • Your consent to receive text messages from Stark Processing applies to Stark Processing only. It is never transferred, assigned, or resold to another business, and it does not extend to our affiliates for marketing or promotional messaging.

  • The only parties who may access your mobile number in connection with our SMS program are the messaging service providers and telecommunications carriers strictly necessary to transmit the messages you asked to receive. They act on our behalf, may use the number only to deliver those messages, and may not use it for their own marketing.

  • We may disclose a mobile number without your consent only where legally compelled to do so, for example in response to a valid subpoena, court order, or other lawful request.

SMS Program Terms

If you check the SMS consent box on one of our forms, you consent to receive SMS text messages from Stark Processing regarding loan processing updates, document extraction statuses, and account notifications.

  • Consent is not a condition of purchase or of receiving any service from us. You may use every part of our service without opting in to text messages.

  • Message frequency varies based on the activity on your file.

  • Message and data rates may apply. Your mobile carrier’s standard rates apply to messages you send and receive.

  • To opt out, reply STOP to any message at any time. You will receive a single confirmation, and we will send no further texts unless you opt in again.

  • Carriers are not liable for delayed or undelivered messages.

We retain a record of your opt-in (including the date, time, and form used) and of any opt-out, in order to honor your choice and to demonstrate compliance with applicable law. That record is used for those purposes only.

6. Nonpublic Personal Financial Information

Because we provide loan processing services, some of the information we handle is nonpublic personal financial information protected under the Gramm-Leach-Bliley Act (GLBA) and its implementing regulations. We do not disclose that information about our clients or their borrowers to anyone except as permitted by law and as described in this Policy, principally to the lender, broker, or settlement service provider involved in your transaction, and to service providers acting on our behalf. We maintain physical, electronic, and procedural safeguards intended to protect it.

7. Cookies, Analytics, and Advertising Technologies

We use cookies, pixels, and similar technologies to operate the Site, remember your preferences, understand how the Site is used, and measure our advertising. The Site currently loads:

  • Google Analytics 4, for aggregate traffic and behavior measurement.

  • Google Ads conversion tracking, to attribute form submissions to our own advertising.

  • Meta (Facebook) Pixel, to measure and optimize our advertising on Meta platforms.

These providers may set cookies and collect device and usage identifiers, and may use that data in accordance with their own privacy policies. You can control cookies through your browser settings, and you can opt out of Google Analytics using the Google Analytics opt-out browser add-on, of Google personalized advertising at Google Ads Settings, and of Meta personalized advertising in your Meta account ad preferences. Industry opt-out tools are also available from the NAI and the DAA.

Do Not Track: Browsers may transmit a “Do Not Track” signal. There is no uniform industry standard for responding to it, so we do not currently respond to DNT signals. We do honor recognized opt-out preference signals such as Global Privacy Control (GPC) where applicable law requires it.

Blocking cookies will not prevent you from using the Site, but some features may not work as intended.

8. How Long We Keep Your Information

We keep personal information only as long as necessary for the purposes described in this notice, unless a longer period is required or permitted by law (for example, tax, accounting, mortgage recordkeeping, or dispute resolution requirements). Loan file records are generally retained for the period required by applicable lending and state law. SMS opt-in and opt-out records are retained for as long as needed to honor your preference and demonstrate compliance. When information is no longer needed, we delete it or de-identify it.

9. How We Keep Your Information Safe

We maintain appropriate technical and organizational measures designed to protect personal information, including encrypted transport (HTTPS), access controls, and restricted document storage. However, no method of transmission or storage is completely secure, and we cannot guarantee the security of the internet itself. Transmission of personal information to and from the Site is at your own risk; please access the Site from a secure environment.

10. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Request access to, and a copy of, the personal information we hold about you

  • Request correction of inaccurate information

  • Request deletion of your information, subject to legal retention requirements

  • Request that we restrict or object to certain processing

  • Request portability of information you provided to us

  • Withdraw consent at any time, including SMS consent (reply STOP)

  • Not be discriminated against for exercising any of these rights

California Residents (CCPA/CPRA)

California residents have the rights listed above, plus the right to know the categories of personal information we collect, the sources, the business purposes, and the categories of third parties to whom we disclose it, all of which are described in Sections 2 through 7. We do not sell personal information, and we do not share personal information for cross-context behavioral advertising as those terms are defined under the CPRA. We have not sold or shared personal information in the preceding twelve months. We do not knowingly collect or sell the personal information of consumers under 16 years of age.

Other U.S. State Residents

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, and other states with comprehensive privacy laws may have similar rights, including the right to appeal a denied request. If we deny your request, you may appeal by replying to our decision or writing to the address in Section 14; we will respond within the period your state’s law allows.

How to Exercise Your Rights

Email laurie@starkprocessing.com with the subject line “Privacy Request,” or write to us at the address in Section 14. We will verify your identity before acting, typically by confirming information already in our records, and will respond within the timeframe required by applicable law. An authorized agent may submit a request on your behalf with written proof of authorization.

11. Children’s Privacy

The Site and our services are intended for business users and adults aged 18 and over. We do not knowingly collect personal information from children under 13 (or under 16 where applicable law sets that threshold). If you believe a child has provided us personal information, contact us and we will delete it.

12. Third-Party Websites

The Site may link to third-party websites, including lender portals and document upload services. This Privacy Policy does not apply to those sites, and we are not responsible for their content or privacy practices. Review the privacy policy of any third-party site before providing information to it.

13. Updates to This Policy

We may update this Privacy Policy from time to time. The updated version is indicated by a revised “Last Updated” date and takes effect as soon as it is accessible. If we make material changes, we will provide more prominent notice where required by law. We encourage you to review this notice periodically.
